DMCA Slow and14 Day Credit Pend Not Enough

This thread topic is about DMCA taking to long which in itself is a legal discussion, not sure what advice you are referring to.

IMVU is not responsible for policing copyright issues, can't you people understand that. That is why they must follow DMCA. It is up to the affected party to deal with the offending party outside in a legal venue. Quit trying to make this IMVU's issue.

I don't steal textures or meshes, I know the process and have helped others with it. I have only used it once myself on an alt account, back then process was very quick. Then again there wasn't as many problems.

I have bought meshes and textures from devs and use them in accordance with the conditions set out by the devs or the stock photo sites I use.

I have notified devs of possible thefts, which I have been informed were sales to others or in some cases alt accounts.

I have also notified devs of thefts that were indeed thefts and they file a DMCA and the product disappears quickly, this is the first I have heard of DMCA taking 2 weeks.

Please do tell me what advice I should listen to myself. Other than help on how to file DMCA, the topic is considered a legal one and should not be in the forums to begin with according to the TOS.

Anyway ... I think Chic has brought great ideas for helping the process and discouraging the thieves. After giving it some thought, I honestly do not think a longer credit pending is a solution for slowing down thieves. I know first hand the mods are paying attention to this thread as per private conversation yesterday. These are definitely valid points toward slowing down, "helping the process", and are being considered. They too want the process to be speedy and the thieves to be stopped.

It's almost getting off topic here. Very Happy This topic is about slow DMCA process AND thieves not being punished at all. Especially repeat offenders. Plus, stolen products remain in purchasers' inventory indefinitely (and thief can keep profits), but they remove re-rated and UFI products immediately and refund credits. This is pretty unfair, no? I as a developer find it insulting.

I agree.. So everyone that has purchased from the thief gets to use the products with stolen textures because the products are not removed like UFI and rerate items. And there is nothing stopping these thieves from putting those stolen textures on something else after the fact. Then we find ourselves having to watch their catty. It's a cycle that never ends. I think encrypting meshes and some type of internal signature are great ideas. Not sure what a solution would be to speed "the process up". As it's been mentioned over and over again in here :/ that is a legal process. Anyway ...

Hi, we have a pend thread: Here All pend topics/suggestions should be posted there. Legal discussions and off topic posts are not allowed. Those who would like credits or money for lost sales due to theft can speak with an attorney.

As to when IMVU disables those stealing and how many times does it take- it’s outlined in the DMCA. An attorney can go over the DMCA with us or we can read the DMCA by searching keyword: DMCA. IMVU abides the DMCA and does disable in accordance to the DMCA.

The DMCA also goes over why IMVU does not handle takedown notices/counter notices the same way they do re-rates. Its apples and oranges. Again speaking to an attorney is advised and would clear up all the questions and suggestions.

IMVU will not act on our suggestions if they violate the DMCA. IMVU must abide the process the same as us. We can ask that IMVU make the client safer, we cannot ask them to break the law. We submit products and should learn the law ourselves in case we ever have to file. Please remember that only the real product owner can file a takedown or counter notice. IMVU generally handles takedowns within 2-4 days depending when we file. If we file on a Friday we will have to wait for IMVU to reopen on Monday and get caught up on the takedowns and counters. IMVU is closed on weekends.

If anyone has waited more than four days they should poke a mod or re-file the takedown. It means the email never made it or was lost in the shuffle. We can also just fax the notice to IMVU as well.

Locking-questions answered. Please seek an attorney for all DMCA questions or search online. Thanks
